Legal Status in Minnesota
Adult-use cannabis became legal in Minnesota on August 1, 2023. Adults 21 and older can legally possess, use, and grow cannabis within specific limits.
Cannabis is regulated by the Minnesota Office of Cannabis Management (OCM), which oversees licensing, safety, and compliance across the state.
How Much Cannabis Can You Have?
If you’re 21+, you can legally possess:
- Up to 2 ounces of cannabis flower in public
- Up to 2 pounds at home
- Up to 8 grams of cannabis concentrate
- Edibles with up to 800 mg total THC
- Cannabis paraphernalia is also legal
You can also gift cannabis to another adult (21+) as long as it stays within legal possession limits.
Can You Grow Cannabis at Home?
Yes. Minnesota allows home cultivation with a few rules:
- Up to 8 plants per household
- Only 4 plants can be mature (flowering) at once
- Plants must be:
- Grown at your primary residence
- Kept in a locked, enclosed space
- Not visible to the public
Where Can You Consume Cannabis?
Cannabis use is allowed:
- In private residences
- On private property (if the owner allows it)
- At future licensed consumption spaces or events (not widely available yet)
Where You Can’t Use Cannabis
Cannabis use is prohibited in:
- Public schools and school buses
- Correctional facilities

- Anywhere smoke or vapor could affect minors
- Indoor spaces where smoking is already banned under the Minnesota Clean Indoor Air Act
Smoking or vaping is also restricted in multi-unit housing, including balconies and patios.
